Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Zonster LLC, a Wyoming limited liability company (“Zonster,” “we,” “us” or “our”), which operates the Brooklyn Pacific platform. They apply to this website at brooklynpacific.com and to the Brooklyn Pacific platform at hq.brooklynpacific.com (the “Platform”). By using the website or the Platform, you agree to these Terms. If you do not agree, do not use them.
The Platform is private
The Platform is a private operations tool that we use to run the brands, stores, social media accounts, advertising accounts and creator accounts that we own or operate. It is not offered to the public, it has no sign-up, and we do not sell subscriptions to it. Only our owner and people we specifically authorize (“authorized users”) may access it, and only for our business.
We may change, add or remove Platform features at any time. Where a reviewer from a platform partner is given access to a demonstration workspace to evaluate an integration, that access is limited to the review and these Terms apply to it.
Using this website
This website provides information about Brooklyn Pacific and links to the Platform’s login page. You may view it for lawful, personal or business purposes. Do not attempt to disrupt it, probe it for vulnerabilities without our written permission, or use it in a way that violates the law.
Authorized users and security
- Authorized users must keep their credentials and multi-factor authentication devices secure and must not share them.
- Authorized users must tell us immediately at info@brooklynpacific.com if they suspect unauthorized access.
- We may require additional verification, limit access to specific features, or revoke access at any time.
- Access is personal to each authorized user and may not be transferred.
Third-party services
The Platform connects to third-party services, such as Google, YouTube, TikTok, Meta (Facebook, Instagram and Threads), Amazon and Fanvue, through their official APIs and with the account owner’s authorization. Your use of each service remains subject to that service’s own terms and policies, and the service may change or end its API at any time.
- YouTube. The Platform uses YouTube API Services. By connecting a YouTube channel or using the Platform’s YouTube features, you agree to be bound by the YouTube Terms of Service. Google’s use of your information is described in the Google Privacy Policy, and you can revoke the Platform’s access at any time through the Google security settings page.
- Google. Use of Google services is subject to the Google Terms of Service.
- TikTok. Use of TikTok is subject to the TikTok Terms of Service.
- Meta. Use of Facebook and Instagram is subject to the Meta Terms of Service and the Instagram Terms of Use.
- Amazon. Use of Amazon seller and advertising accounts is subject to the Amazon Services Business Solutions Agreement and the Amazon Ads terms.
- Fanvue. Use of Fanvue is subject to the Fanvue Terms of Service.
We are not responsible for third-party services, their availability, or how they handle information on their own platforms. Our handling of information received from them is described in our Privacy Policy.
Acceptable use
Authorized users must not use the Platform to:
- break any law or regulation, or infringe anyone’s intellectual property, privacy or other rights;
- violate the terms, policies, community guidelines or API rules of any connected service;
- send spam, unsolicited bulk messages, or deceptive or misleading content;
- impersonate any real person, or publish content depicting a real person’s likeness without permission;
- publish content that is unlawful, harassing, hateful, sexually explicit, or harmful to minors;
- access accounts or data they are not authorized to access;
- circumvent rate limits, security controls, approval rules or audit logging; or
- copy, reverse engineer, resell or provide the Platform to anyone else.
Content and AI-generated drafts
We and the brands we operate own the content we create and publish through the Platform. The Platform uses artificial-intelligence services to help prepare drafts such as captions, replies, listing copy and images. AI output can be inaccurate or inappropriate, so drafts are reviewed and approved by a person before they are published, sent or acted on, except where they fall within narrow rules we set and monitor.
We apply AI-content labels and disclosures where a connected service requires them, using that service’s own labeling tools. The person who approves content is responsible for checking that it is accurate, lawful and compliant with the connected service’s rules.
Privacy
Our Privacy Policy explains what information we access from connected services, how we use, store, retain and delete it, and how to request deletion. It forms part of these Terms.
Intellectual property
The website and the Platform, including their software, design and the Brooklyn Pacific name and marks, belong to us or our licensors and are protected by law. These Terms do not grant you any right to use them except as needed to use the website or, for authorized users, the Platform. Third-party names and marks belong to their owners.
Suspension and termination
We may suspend or end any user’s access to the Platform at any time, with or without notice, including to protect security or to comply with the law or a connected service’s rules. When a connected account is disconnected or access ends, information from that account is deleted as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity and governing law.
Disclaimers
The website and the Platform are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the website or the Platform will be uninterrupted, error-free or secure, or that information shown in them (including data from connected services and AI-generated drafts) is complete or accurate. Nothing on the website or in the Platform is financial, legal or tax advice.
Limitation of liability
To the fullest extent permitted by law, Brooklyn Pacific and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the website, the Platform or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to them will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnity
Authorized users agree to defend, indemnify and hold harmless Brooklyn Pacific from any claims, losses and expenses (including reasonable legal fees) arising from their misuse of the Platform or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction, except where the law of your place of residence gives you the right to bring a claim elsewhere.
Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date above. Continuing to use the website or the Platform after an update means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest remains in effect, and our not enforcing a provision is not a waiver of it.
